1. Agreement to these terms
By creating an account, submitting a review or otherwise using Proof Pin (the “Service”), you agree to these Terms of Use and our Privacy Policy. If you use Proof Pin for a business, you confirm that you are authorized to accept these terms for that business. If you don’t agree, please don’t use the Service.
You must be at least 18 years old, or the age of majority where you live, to create an account.
2. What Proof Pin does
Proof Pin lets businesses log completed jobs, send customers a link to leave a review and photos, place projects on a privacy-safe map, generate marketing drafts with AI, and display projects and reviews on their own website through an embed. We may add, change or remove features over time.
3. Your account
Keep your login details secure and your account information accurate. You are responsible for all activity under your account. Tell us right away at [email protected] if you believe your account has been compromised.
4. Plans, trials and billing
Some features require a paid plan. Prices and plan limits are shown on our pricing page or at checkout. Unless stated otherwise:
- Paid plans renew automatically each billing period until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current period.
- Free trials last for the period shown when you sign up. If a payment method is required, you will be charged when the trial ends unless you cancel first.
- Fees are non-refundable except where required by law.
- We may change prices with at least 30 days’ notice. Changes apply from your next billing period.
5. Contacting your customers
When you add a customer and send a review request, you are the sender and are responsible for having a real customer relationship and any permission required by law. You agree to:
- Only add people who actually hired your business for the job you entered.
- Follow anti-spam and privacy laws that apply to you, including the CAN-SPAM Act, and honor opt-out requests promptly.
- Not use Proof Pin to send marketing messages unrelated to requesting feedback on completed work.
6. Honest reviews
Proof Pin must only be used to collect genuine reviews from real customers. You may not:
- Write, buy or submit fake reviews, or review your own business.
- Offer payment, discounts or other incentives in exchange for positive reviews, or make an incentive depend on the review being positive.
- Edit a reviewer’s words, or present a review as a customer’s words when it isn’t.
- Pressure, threaten or mislead customers about their reviews.
These rules reflect the U.S. Federal Trade Commission’s rule on consumer reviews and testimonials, as well as the policies of Google and other review platforms. You are responsible for following those rules and policies when you publish content.
7. For reviewers
If you submit a review through a Proof Pin link:
- Share only your honest experience, and only upload photos you took or have the right to share.
- Don’t include other people’s private information, or anything unlawful, hateful or harassing.
- You give the business, and Proof Pin on its behalf, a non-exclusive, royalty-free, worldwide license to display, reproduce and share your rating, review, first name and photos. That includes the business’s website, social media, Google Business Profile and other marketing, plus short summaries or posts based on your review. You can ask for your review to be removed at any time, as described in our Privacy Policy.
8. Your content
You keep ownership of the content you add to Proof Pin, such as business details, job information, photos and edits (“Your Content”). You give us permission to host, store, process and display Your Content only as needed to provide and improve the Service, including showing it through your embed.
You confirm that you have the rights and permissions needed for Your Content, including customer information and any review content you publish.
9. AI-generated content
Proof Pin uses AI to draft posts and descriptions from your job details and reviews. AI output can be inaccurate or incomplete, and similar wording may appear for other users. Review and edit every draft before you publish it. You are responsible for what you publish.
Subject to these terms, you may use the drafts generated for your account for your business’s marketing.
10. Website embeds
You may place the Proof Pin embed only on websites you own or control, and only on the domain you authorize in your settings. The embed shows approximate project locations, not exact addresses, and includes “Powered by Proof Pin” attribution. Don’t remove that attribution or modify the embed to show hidden data. We record embed views to show you usage and to block unauthorized sites.
11. Acceptable use
You agree not to:
- Break any law or anyone else’s rights, including privacy, publicity and intellectual property rights.
- Upload malware, or content that is unlawful, defamatory, obscene or harassing.
- Try to access other accounts or data, get around security or usage limits, or scrape the Service.
- Resell or sublicense the Service without our written permission.
- Use the Service to build a competing product.
12. Third-party services
Proof Pin relies on third-party services such as Google, OpenStreetMap-based map and address services, the U.S. Census Bureau, OpenAI and email providers, and lets you publish to platforms like Google Business Profile, Facebook and Instagram. Your use of those platforms is governed by their own terms. We are not responsible for third-party services or for decisions those platforms make about your content or listings.
13. Our intellectual property
Proof Pin, its logo, software, design and documentation belong to Proof Pin LLC and its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. If you send us feedback or ideas, we may use them without obligation to you.
14. Suspension and termination
You can stop using Proof Pin and close your account at any time. We may suspend or terminate access if you break these terms, if your use creates legal or security risk, or if we stop offering the Service. Where reasonable, we will give notice and a chance to export your data. Sections that by their nature should survive, such as licenses already granted, disclaimers, limits of liability and indemnity, will survive termination.
15. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular number of reviews, search rankings, leads or business results, or that the Service will be uninterrupted or error-free.
16. Limitation of liability
To the fullest extent allowed by law, Proof Pin LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some jurisdictions don’t allow these limits, so they may not fully apply to you.
17. Indemnity
If you use Proof Pin for a business, you agree to defend and indemnify Proof Pin LLC against claims, damages and costs, including reasonable legal fees, that arise from Your Content, your communications with customers, the reviews or content you publish, or your breach of these terms or of the law.
18. Governing law and disputes
These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Wisconsin, and both parties consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.
19. Changes to these terms
We may update these terms from time to time. We will update the effective date above and, for material changes, notify account holders by email or in the app. If you keep using the Service after changes take effect, you accept the updated terms.
